What are the Steps to Modify Child Support in Florida?

In Florida, the law allows either parent to request a modification of child support if there has been a substantial change in circumstances. This could include a significant change in one parent’s income or the child’s financial needs.


What Qualifies as a Substantial Change?

Florida courts have made it clear that a substantial increase in the paying parent’s income alone can be enough to justify a child support modification — even if there isn’t proof that the child’s needs have increased. This was reaffirmed in the case of Ali v. Sanchez (4D2024-0114 (Fla. 4th DCA January 15, 2025) , where the father’s income had more than doubled. Despite this, the trial court denied the mother’s request for modification. On appeal, the court ruled that this type of income change, by itself, warrants revisiting child support.
